The role of a Justice of the Peace (JP) in Australia is focused on certifying true copies of original documents and witnessing affidavits or statutory declarations for use within Australia. JP’s carry out their role as a volunteer of good character and standing in the community.
If you are thinking of engaging the services of a JP to certify a copy of a document or witness your signature for overseas use you should confirm with the receiving overseas authority whether this will be acceptable.
This is because a JP in Australia is not permitted to witness the execution or certify documents for use in foreign countries. A Notary Public does all of those tasks.
A Notary Public is a qualified lawyer who is appointed as a public officer. A Notary Public can provide you with the following services:
- Certify copy documents
- Taking declarations and receiving affidavits for production abroad and notarial certifications
- Verification, authentication and certification of Powers of Attorney, University Testamurs/Transcripts, Wills, Deeds, Contracts and other legal documents for presentation abroad
- Notarising documents such as resolutions, minutes, reports and corporate governance certificates
- Notarising the execution of Powers of Attorney and other commercial documents
- Prepare Certificates of Good Standing for Australian companies
- Advice relating to the authentication and verification of documents to be produced and acted upon abroad
- Obtaining an authentication
- Obtaining an Apostille Certificate
